Patient Privacy

NSW Health Pathology is committed to safeguarding the privacy of patient information and has implemented measures to comply with its obligations under the Health Records and Information Privacy Act 2002.

All staff working in the NSW public health system, including pathologists, collection centre staff, laboratory scientists and others are bound by law, by the NSW Health Privacy Manual for Health Information, and by a strict code of conduct to maintain confidentiality of patient information.

If you have a complaint relating to your privacy on the grounds that you believe a health or pathology provider involved in your care has contravened a Health Privacy Principle or Health Privacy Code, you may wish to request an internal review to be carried out.

If you are dissatisfied with the outcome of the internal review, you may lodge an appeal with the NSW Civil and Administrative Tribunal (NCAT) which may further investigate your complaint.

Privacy Leaflet for Patients

Our Patient Privacy Leaflet summarises  our responsibilities under privacy laws in relation to patient health information. The leaflet tells patients how they can expect their personal health information to be collected, stored, used and disclosed by NSW Health Pathology. It is the most important privacy related document which health services need to provide to patients.

It is a legal requirement that the information contained in the leaflet be made available to all patients, clients and others from whom personal health information is collected. Therefore health services have an obligation to make this leaflet as widely available as possible. 

Privacy Information for Staff

Our Privacy Information for Staff Leaflet guides the distribution and display of the Privacy Leaflet for Patients.

This brochure is to assist NSW Health staff understand and comply with the legislative obligations under the Health Records and Information Privacy Act 2002. It explains what staff need to do with regards to:

  • collecting personal health information from patients 
  • when to collect consent from patients regarding information sharing 
  • when use and disclosure of personal health information is permitted 
  • what staff obligations are to keep personal health information secure 
  • what to do if an individual complains that a staff member has breached their privacy 
  • where to go and who to speak to for further information

Privacy Training for Staff

Staff awareness and understanding of patient privacy should be promoted in a routine and ongoing way. Staff should have access to training in privacy principles and requirements.  Staff should contact the Information Manager or their Manager about face-to-face training.

Online privacy training resources are also available via the Health Education and Training Institute website.

Staff will be required to register and create an account prior to logging on. The privacy modules can be found under the heading 'Communication'. There are two online privacy training modules available as follows:

  • Privacy Module 1 - Know Your Boundaries.  This training program is suitable for all NSW Health staff.
  • Privacy Module 2 - Handling Personal and Personal Health Information. This training is suitable for NSW Health staff with responsibility for managing personal and health information.
